Applying for Spanish citizenship from New York usually involves two separate questions: which legal route applies to you, and how do you prove it? We address them in that order.
At Díaz & Asociados, we can:
we examine relevant relationships, dates of birth and citizenship history before recommending a route.
when a Spanish birth certificate is missing, we identify the appropriate Civil Registry, municipality, parish or historical archive.
we check whether certificates are in the correct format and whether authentication or a Hague Apostille is required.
if an official translation into Spanish is necessary, we explain what type of translation will be accepted.
we organize the documentary chain and identify inconsistencies before filing.
we explain which authority is competent, which steps can be handled remotely and when you may need to appear personally.
where included in our engagement, we review official communications and requests for additional or corrected documentation.
when applicable, we prepare you for the swearing-in ceremony and subsequent Civil Registry steps.
The objective is not simply to collect as many documents as possible. It is to build the right documentary file for the legal route that actually applies.
A legal team by your side, no matter the distance.
Díaz & Asociados does not have a physical office in New York.
We work from Spain and meet U.S. clients by video call. For Spanish citizenship matters, this allows us to handle the Spanish legal and documentary side of the case directly while you remain in the United States.
Depending on your residence and legal route, some formalities may involve the Consulate General of Spain in New York. Its official jurisdiction covers New York, New Jersey, Connecticut, Pennsylvania and Delaware. Check the official jurisdiction of the Consulate General of Spain in New York.
We check the competent authority before preparing your documents so you know:
Our work concerns Spanish citizenship and Spanish law. If you need advice about your immigration status in the United States, you should work with a U.S.-licensed immigration professional.
Even apparently straightforward family histories can become complicated once documents from several generations are compared.
A U.S. certificate can be perfectly valid in New York and still require additional formalities before a Spanish authority will accept it.
For documents issued by U.S. states, the authentication process depends on the state that issued the document. The U.S. Department of State distinguishes state-issued documents from federal documents when explaining how documents are prepared for use abroad under the Hague Apostille system. See the U.S. Department of State guidance on apostilles.
We first determine which version of the document is needed and then review authentication, apostille and translation requirements. This helps avoid ordering the same certificate twice.
Your family may live in New York today while the relevant birth, marriage or death took place in New Jersey, Pennsylvania, Florida or another state.
Each record must normally be requested from the authority that holds it, and the authentication process follows the rules applicable to the issuing jurisdiction.
We help you organize that documentary chain instead of treating every U.S. document as if it followed the same process.
Marriage, immigration, anglicization or simple registry errors can cause the same person to appear under different names or surnames.
For example, one certificate may use two Spanish surnames while a later U.S. record keeps only one.
We review these discrepancies before filing and determine whether additional evidence or a correction is necessary.
Spanish citizenship by descent is not one single procedure. The applicable route depends on who in your family was Spanish and when.
The principal rules are contained in Articles 17 through 26 of the Spanish Civil Code. Consult the current Spanish Civil Code on the BOE website.
Common situations include:
Your father or mother was Spanish when you were born: under Article 17, you may be Spanish by origin if the legal requirements are met.
Your father or mother was originally Spanish and born in Spain: Article 20 may provide a right of option.
You were born outside Spain and your parent or grandparent was originally Spanish: Article 22 may allow you to apply after one year of legal, continuous residence in Spain immediately before the application, provided the other requirements are met.
A more distant Spanish ancestor, such as a great-grandparent, does not automatically give every descendant a direct right to citizenship. That is why we identify the legal route before asking you to obtain certificates.
You can find a more detailed explanation in our guide to Spanish citizenship by descent, as well as our separate content on Spanish great-grandparents and dual citizenship between Spain and the United States.
We begin with the family information and documents you already have. You do not need a complete genealogy before contacting us.
We review your family relationships, citizenship history and existing evidence to identify the route that should be considered.
We identify missing Spanish and U.S. certificates, review discrepancies and determine which documents require an apostille or sworn translation.
Once the documentary chain is complete, we organize the application according to the relevant procedure.
For residence-based citizenship, the Spanish Ministry of Justice provides an official electronic application procedure and information about the documentation and subsequent stages. See the official Spanish citizenship-by-residence procedure.
Where included in our service, we monitor official communications and help respond to requests to correct or complete the application.
Depending on the route, registration, personal appearances or a swearing-in ceremony may still be required after approval.
For citizenship by residence, the Ministry of Justice explains the requirements and final stages of the process on its official citizenship-by-residence page. See the Ministry of Justice information on Spanish citizenship by residence.

We do not promise the same timeline for every case. Record searches, corrections, consular appointments and processing times can all affect the overall duration. Before starting, we also explain what our quote includes and which external expenses —such as certificates, apostilles or translations— are separate.
For your first consultation, it helps to have:
Online ConsultationIf you have no documents yet, that is not a problem. We can start with names, dates and locations and determine where the documentary search should begin.
No. Díaz & Asociados works directly from Spain and assists New York clients by video call and remote document exchange. We do not claim or maintain a physical office in New York.
It depends on the legal route. Some procedures can be handled through the competent Spanish consulate, although personal appearances may still be required. Citizenship by residence requires you to complete the applicable period of legal residence in Spain.
The quote depends on the legal analysis, number of documents involved, record searches and any corrections or additional work required. We define the scope before starting and identify external expenses separately when they are not included.
We use the family information available —names, approximate dates, places and later certificates— to narrow the search and identify the appropriate Spanish Civil Registry, parish or historical archive. You do not need to have every record before contacting us.
